Application of the contract

The contract is formed by the fact that the supplier confirms to the customer having accepted the transaction of this last one thanks to the registration and communicates to the customer the informations needed to connect and the necessary password to use the service by e-mail.

Z51 reserves the right to refuse, without supplying any explanations the registration

Object of the contract

The supplier gives access to his customers to the servers of Usenet and stays a technical intermediary between the Usenet network and the customer.
The supplier only provide access to Usenet servers and does not manage the contents of these servers. All the contents appearing on these servers result from customers of thousand Usenet servers from many other providers to whom the supplier gets the access to his customers, exchange automatically and permanently data. The customer knows as such that the contents are contents from third party and not from Z51.
The supplier can not be considered responsible for these contents. The supplier give acces to the usenet network only.
to be able to use the service, the customer receives a login and password to reach the Usenet Network, thanks to a newsgroup reader software. The customer is free to use the newsgroup client of his choice.
To reach Usenet, the customer has to register. The supplier who has a guaranteed evolving bandwidth every week is entitled to restrict the transfer of data and to exclude the access of the customer when the technical performances of the service are compromised and\or when the supplier believes that the customer uses the service in unfair purposes, the supplier will inform immediately the customer of the restrictive measures as soon as possible and as the case may be if a refund is envisaged.

Speed and amount of Data

The bandwidth is guaranteed in our DATACENTER. To limit the abuses and avoid compromising the performances for 99 % of the customers by 1 % of very big downloaders, the account will be desactivated after 500 GB of download in the credit period, this limit is reset to zero each time the customer add more credits to his account
These limits may evolve without notice, this clause has for only interest to protect the global performances of the platform for 99 % of our customers.

Termination of the contract

the contract is concluded for an agreed contractual period. The contract begins with the delivery of identifiers by the supplier.
The subscription is payable beforehand for a contractual period chosen by means of a payment by credit card and\or by the service Paypal.
By his registration, the customer expressly declares to accept that the supplier produces beforehand the corresponding total amounts. The customer receives a receipt by e-mail.
If a transaction is refused, the contract will be considered useless and not applicable.
By his registration, the customer assures to be the legal holder of the bank account indicated by him, or to be proxy enjoying the right to use it.
The contract and the obligations of the customer/supplier come to an end automatically at the end of contractual period signed initially, strong> no tacit or express renewal will be established . Obligations of the customer

Use of the service

The supplier declines any guarantee and responsibility to the downloaded contents whatever is their nature. If the customer authorizes minors to reach Internet and Usenet by his access, the customer assumes the exclusive responsibility. The customer knows that certain contents of Usenet can not be adapted to the minors.
The supplier is not responsible for these contents, he contents with supplying the necessary service to reach these contents and the customer notes that it is in the nature of newsgroups, freely accessible to each, that it can contain, under the circumstances, offensive, harmful texts, indistinct or inconvenient for quite other reason, or protected by whatever motive it is, or not corresponding to the truth in some cases or deceivers in a different way. During the use of the service, the customer makes a commitment to show caution, common sense, a healthy faculty of difference, and to respect the legal regulations.
The customer agrees to assume the responsibility of his own communiqués and the consequences which ensue from it. Limitations of responsibility, protection of the data and the anonymity

The supplier answers only attributable damage deliberate violations or fruits of the grave negligence committed by the supplier. The service is accessible 24/7 without that it is about a guarantee this way.
